Business Licensing Enforcement Resolution
A RESOLUTION TO ESTABLISH A ONE-STRIKE BUSINESS LICENSE REVOCATION STANDARD FOR UNLAWFUL EMPLOYMENT PRACTICES AND TO PROTECT
LAWFUL WORKERS AND COMPLIANT EMPLOYERS.
WHEREAS, the ____________________ Governing Body is vested with authority to issue, regulate, suspend, and revoke business licenses within its jurisdiction; and
WHEREAS, lawful employment practices are essential to protecting workers, maintaining fair competition among businesses, and preserving the integrity of the local labor
market; and
WHEREAS, businesses that knowingly employ or harbor unauthorized workers gain an unfair competitive advantage over law-abiding employers and undermine wage
standards; and
WHEREAS, existing enforcement mechanisms often fail to provide sufficient deterrence against repeated or deliberate violations of employment law; and
WHEREAS, the Governing Body finds that a clear, predictable, and decisive licensing consequence is necessary to promote compliance and protect the public interest;
NOW, THEREFORE, BE IT RESOLVED BY THE ____________________ GOVERNING BODY:
SECTION 1. Purpose and Intent
The purpose of this resolution is to establish a strong administrative enforcement standard for business licensing that deters unlawful employment practices, protects lawful
workers, and ensures a fair and compliant business environment. This resolution operates through civil and administrative processes and does not create or expand criminal
liability.
SECTION 2. Applicability
This resolution applies to all businesses required to hold a business license issued by ____________________.
SECTION 3. Prohibited Conduct.
A business license holder shall be deemed in violation if it knowingly employs or harbors unauthorized workers or fails to comply with mandatory employment verification
requirements where required by law.
SECTION 4. One-Strike License Revocation
Upon a verified finding of a violation, the business license of the offending license holder shall be revoked.
SECTION 5. Reissuance and Disqualification
A revoked business shall be ineligible to receive a new license for _____ years from the effective date of revocation, unless otherwise required by law.
SECTION 6. Notice and Administrative Process
Prior to revocation, the license holder shall receive written notice and an opportunity to respond through an administrative process that complies with due process requirements.
