Local Employment Protection Act

A RESOLUTION ESTABLISHING WORKFORCE, WAGE, AND COMPLIANCE STANDARDS

FOR PAYMENT-IN-LIEU-OF-TAXES (PILOT) AGREEMENTS AND OTHER PUBLIC INCENTIVES

WHEREAS, the ____________________ Governing Body has authority to approve tax abatements, Payment-in-Lieu-of-Taxes agreements, and other public incentives; and

WHEREAS, public incentives represent a substantial commitment of taxpayer resources and should produce measurable public benefits; and

WHEREAS, ensuring lawful hiring practices, fair wages, and local workforce participation strengthens the economic return on public incentives; and

WHEREAS, the Governing Body seeks to establish clear and enforceable standards applicable to all PILOT agreements and similar incentive arrangements;

NOW, THEREFORE, BE IT RESOLVED BY THE ____________________ GOVERNING

BODY:

SECTION 1. Applicability

This resolution applies to all Payment-in-Lieu-of-Taxes agreements and public incentive arrangements approved by ____________________ after the effective date.

SECTION 2. Local Employment Standards

Projects receiving incentives shall ensure that at least _____% of full-time positions are filled by local residents as defined by ____________________.

SECTION 3. Wage and Benefit Standards

Positions counted toward incentive benchmarks shall meet or exceed prevailing wage or $______, whichever is higher, and include employer-provided health insurance.

SECTION 4. Lawful Hiring and Verification

Recipients shall comply with all applicable employment verification requirements, including E-Verify where required by law, and shall maintain documentation demonstrating

compliance.

SECTION 5. Reporting and Certification

Recipients shall submit annual certifications attesting to compliance with workforce, wage, and verification requirements as a condition of continued incentive eligibility.

SECTION 6. Enforcement and Remedies

Failure to comply may result in proportional reduction, suspension, or termination of incentives, and recovery of improperly granted benefits, consistent with agreement terms and

applicable law.

SECTION 7. Administration

____________________ is authorized to administer and enforce this resolution and to include corresponding provisions in incentive agreements.

SECTION 8. Severability

If any provision of this resolution is held invalid, such invalidity shall not affect the remaining provisions.
